Man blames injuries on driver who sideswiped his vehicle

A man claims he suffered physical pain after a driver sideswiped his vehicle.

Joshua James filed a lawsuit Sept. 4 in Jefferson County District Court against Atia Joseph Bourque. 

In his complaint, James claims he was driving in Beaumont on March 4 when Bourque, who was driving on the same road, failed to safely change lanes and struck his vehicle.

Because of the collision, James suffered physical pain and mental anguish, incurred medical costs and endured physical impairment, according to the complaint. He also lost wages, the suit states.

James blames Bourque for causing the collision, saying he failed to keep a proper lookout, failed to properly change lanes, failed to apply his brakes and failed to keep proper control of his vehicle.

In his complaint, James seeks a judgment in excess of the minimum jurisdictional limits of the court, plus costs, pre- and post-judgment interest and other relief the court deems just.
