Man alleges severe injuries in forklift accident

A Gregg County man alleges he endured disfigurement after he fell on the forks of a forklift.

Calvin Miller filed a lawsuit Sept. 5 in the Marshall Division of the Eastern District of Texas against Millis Transport.  In his complaint, Miller alleges he was operating a forklift on a portable dock at Giglio Distributing and was unloading a tractor trailer owned by Millis on Sept. 18, 2012. 

"Defendant's driver, Paul Henson, pulled away from the portable dock causing plaintiff to fall from his seat on the forklift onto the forks of the forklift," the suit states. 

In addition to his disfigurement, Miller suffered physical pain and mental anguish, incurred medical costs and endured disfigurement and physical impairment because of the incident, the complaint says. He also alleges he lost earnings.

Miller accuses Millis Transfer of negligence, saying it failed to keep a proper lookout and failed to exercise the same degree of care that a reasonable person would have.

In his complaint, Miller seeks an unspecified judgment, plus pre- and post-judgment interest, costs and other relief the court deems just.
