A Galveston County man has filed suit against Kroger, alleging he sustained injuries when he tripped on a rug at the store.

Bill Don Frazier alleges he was shopping at the Kroger at 151 North Friendswood Drive, Friendswood, on Sept. 22, 2012, when he tripped and fell on an unsafe worn rug that was bunched against a metal railing running across the door entrance. Because of his fall, Frazier suffered injuries to her right foot and toes, according to the complaint filed Sept. 22 in Galveston County District Court.

Because of his fall, Frazier suffered physical pain and mental anguish, endured physical impairment and incurred medical costs, the suit states.

Frazier blames Kroger for contributing to his injuries, saying it failed to provide proper training to its employees, failed to properly monitor or supervise its employees, failed to exercise reasonable care and failed to act as a reasonably prudent person would have under similar circumstances.

In his complaint, Frazier seeks a judgment of more than $100,000 but no more than $200,000, plus pre- and post-judgment interest at the maximum legal rate, costs and other relief the court deems just.
