Male pedestrian claims driver hit him at intersection

A Galveston County man alleges he was injured when a motorist struck him while he was crossing at an intersection.

Richard Walston filed a lawsuit July 8 in the Galveston County District Court against The Gulf Coast Center, also known as Connect Transit, and one of its employees Marvin Johnson, alleging vehicular negligence.

According to the filing, Walston was crossing westbound on a motorized scooter at a designated crosswalk located at the intersection of 34th Street and Palmer Highway in Texas City on May 7, 2014 when Johnson ran a red light while traveling northbound through the intersection and hit Walston causing him to be dragged under the Connect Transit vehicle.

Walston claims Johnson failed to yield right of way at a red light, keep a proper lookout, maintain a safe distance or take evasive action to avoid a collision. Johnson is also faulted with violating numerous transportation codes.

The suit says Walston has endured severe and permanent injuries, as well as past and future pain and anguish, medical expenses, physical impairment and disfigurement.

Walston seeks damages in excess of $200,000, plus court costs and other relief deemed appropriate by the court.

The plaintiff is represented by attorney James D. Nebout of Burwell Nebout Trial Lawyers in Texas City.
