Restaurant patron trips on ramp, sues business

A Galveston County resident is suing a restaurant for premises negligence in 2015 when he allegedly fell on its ramp and suffered injuries.

Mark Henry filed a lawsuit against Samineh Davary, also known as Sam Davary, doing business as Terraza Mexican Bar and Grill in Galveston County District Court on July 31, claiming liability in a February fall which the plaintiff claims left him with serious injuries.

According to the complaint, Henry tripped on a ridged portion of a ramp provided for patrons when he entered the restaurant located at 814 Ninth Ave. N. in Texas City on or about Feb. 13. The suit states that the ramp was dangerous due to its height from the floor and its roughness.

The complaint states that the business was negligent in failing to warn customers of a dangerous condition on the ramp, in constructing and maintaining the ramp in sub-standard condition, and failing to correct the hazard by sanding, smoothing out, removing, or rebuilding the ramp.

The plaintiff seeks between $100,000 and $1 million in compensation for general and special damages, pre- and post-judgment interest, attorney’s fees, expenses, and costs. The plaintiff is represented by Wilbur Dunten of Dunten Law Firm in Dickinson.
