A Missouri City man is suing his former employer, alleging violation of the Fair Labor Standards Act when he says it refused to pay him proper overtime wages.
Gary Craig Connelly filed a lawsuit Aug. 6 against Cokebusters USA Inc. of Houston in the Houston Division of the Southern District of Texas, alleging unlawful employment practices from approximately February-November 2014.
The suit states some of the plaintiff’s principal duties as an inspection technician were to prepare inspection and decoking equipment utilized in the energy industry.
According to the complaint, Cokebusters paid Connelly at varying rates for his labor, but did not pay the appropriate premium for his work in excess of 40 hours in a workweek. The suit says the defendant willfully and intentionally used a pay scheme designed to avoid the one and a half times the plaintiff's regular wages required.
Connelly seeks compensation for unpaid overtime wages, actual, compensatory and liquidated damages, penalties, pre-judgment interest, attorney, expert and mediator fees, expenses and costs. He is represented by attorneys Charles Scalise and Daniel Ross of Ross Law Group in Austin.
