Texas man sues Buffalo Marine Service Inc. following injury at sea

A seaman is suing his Houston maritime employer alleging negligence during a workplace injury which he claims left him permanently disabled.

John Russ Pearson filed a lawsuit against Buffalo Marine Service Inc. in Jefferson County District Court on Aug. 13 claiming negligence in an August 2015 injury.

According to the complaint, the plaintiff was working in the scope of his employment aboard the marine vessel San Kennedy on or about Aug. 11. The lawsuit states that in the process of docking the vessel and its tow, a line broke and struck Pearson, knocking him to the deck and allegedly causing serious injuries.

Pearson maintains that he has endured physical pain, suffering, anguish, impairment, disfigurement, and loss of earnings, as well as medical expenses.

Charging the defendant with failure to properly supervise and train the crew, provide a safe workplace, and implement safety procedures and policies that would have prevented the accident, Pearson seeks maintenance and cure along with damages.

The plaintiff seeks compensation for damages in excess of the minimum jurisdictional amount, pre- and post-judgment interest, attorneys' fees, expenses, and costs. He is represented by Todd Elias and Jeff Seely of Gordon, Elias & Seely in Houston.
