Shopper sues Walmart, alleging pallet trip caused injuries

A Jefferson County resident is suing Wal-Mart Stores Texas LLC, alleging negligence and liability for personal injuries allegedly sustained during a 2013 shopping trip.

Nishia Wilson filed a lawsuit against Wal-Mart Stores Texas LLC in Jefferson County District Court on Aug. 18, claiming premises negligence in an October 2013 slip and fall at the company’s Port Arthur location.

According to the lawsuit, Wilson was a customer at the defendant’s 8585 Memorial Blvd. branch on or about Oct. 3, 2013, shopping in the store’s linens section when she allegedly fell backwards over a wooden pallet that had been left on the floor.

The complaint states that no warning signs were posted and that the store personnel knew or should have known of the danger of leaving the pallet where people could trip over it.

Charging the defendant with breach of ordinary care, the lawsuit states that the plaintiff incurred past and future pain and anguish, physical impairment and disfigurement, lost wages and earning capacity, and medical expenses.

Seeking between $100,000 and $200,000 for damages, pre-judgment interest, attorney’s fees, expenses, and costs, the plaintiff is represented by Jonathan Juhan and J.J. Bragg in Beaumont.
