GALVESTON -- A Colorado man is suing an oil well company, alleging non-payment of overtime. He further seeks class member status for his co-workers.
Michael Stanley of Mesa County, Colo., individually and on behalf of others similarly situated, filed a lawsuit Sept. 18 in the Galveston Division of the Southern District of Texas against Archer Well Company Inc. and Great White Pressure Control LLC, a division of Archer.
The defendants provide oil well drilling services and well maintenance services for oil wells throughout the United States. According to the complaint, Stanley worked for the defendants from April 2012 to May 2014 in Utah, Wyoming and North Dakota.
The suit says his job title is non-exempt and, as such, Stanley and co-workers were due overtime pay pursuant to the Fair Labor Standards Act when they worked more than 40 hours per week.
Stanley and class members seek a trial by jury, a judgment against the defendant for all unpaid overtime and liquidated damages, attorney fees, court costs and other relief the court deems appropriate. He is represented by attorney Don J. Foty of Kennedy Hodges LLP in Houston.
