Galveston Historical Foundation sued after tank falls on seaman

Histo

Texas resident Joe Ochoa has sued Galveston Historical Foundation, Inc. for injuries he reportedly sustained last year while working on a ship operated by the non-profit organization.

Ochoa filed the personal injury lawsuit in the Galveston County 122nd District Court on Sept. 29.

According to the original petition, the plaintiff suffered the injuries off the coast of Galveston on Mar. 24, 2014.

He further explains that he was instructed to move a tank placed on the vessel.

“The tank was extremely heavy and Plaintiff injured himself while trying to pick it up,” the suit states.

GHF is accused the following:

• Failure to properly supervise their crew;

• Failure to provide alternative lifting methods;

• Failure to properly train their employees;

• Failure to provide an adequate crew;

• Failure to safely operate their vessel;

• Operating the vessel with an obvious dangerous condition; and

• Other acts deemed negligent.

Consequently, Ochoa seeks unspecified monetary damages and a jury trial.

He is represented by attorneys Michael E. Pierce and Sofia E. Bruera of the law firm Pierce Skrabanek Bruera, PLLC.
