Driver alleges trucking business violated overtime regulations

HOUSTON — A Houston trucker is suing a trucking company and supervisor, alleging failure to pay overtime wages.

Herman Christophe filed a lawsuit, individually and on behalf of other similarly situated persons, April 20, in the Houston Division of the Southern District of Texas against Aaron Express Inc. doing business as Colt Express and also known as Colt Express Trucking Company, and Sherry Whiteley,  alleging violation of the the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, Christophe worked more than 40 hours but did not receive any overtime compensation from his employer. The plaintiff alleges the defendants did not pay overtime compensation to their employees despite knowing the total hours that they are working.

Christophe requests a trial by jury, actual damages in the amount of unpaid overtime wages, liquidated damages, interest, all legal fees and any other relief the court deems just. He is represented by attorney Charles A. Sturm of Sturm Law PLLC in Houston.
