Houston man alleges debt collector guilty of phone harassment

HOUSTON — A Houston man is suing a debt collector, alleging violation of telephone harassment statutes.

Desroy Dehaney filed a lawsuit April 22 in the Houston Division of the Southern District of Texas against Medicredit Inc. alleging it contacted plaintiff illegally in an attempt to collect a debt.

According to the complaint, beginning in November 2015, Dehaney was called multiple times on his mobile telephone by a prerecorded voice in an attempt to collect a personal debt. The plaintiff alleges Medicredit continued to call the plaintiff despite his request to stop calling him.

Dehaney seeks a trial by jury, actual damages, statutory damages of $1,000 for the violation of FDCPA, $500 per violating telephone call, treble damages of $1,500 per violating telephone call, injunctive relief, all legal fees and any other relief the court deems just. He is represented by attorney Amy L. Bennecoff Ginsburg of Kimmel & Silverman PC in Ambler, Pennsylvania.
