HOUSTON – A Harris County man alleges he was not paid overtime wages while employed as an account manager and has filed a class action against his former employers.
Angel Meza filed a complaint on behalf of all others similarly situated employees and former employees of defendants on May 24 in the Houston Division of the Southern District of Texas against Diligent Health LLC and Diligent Acquisitions LLC, both doing business as Diligent Delivery Systems alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between July 7, 2014, and Nov. 1, 2015, he worked for more than 40 hours but did not receive any overtime compensation. The plaintiff holds Diligent Health LLC and Diligent Acquisitions LLC responsible because the defendants allegedly failed to pay a rate of time-and-one-half to their employees working for more than 40 hours at a given work week.
The plaintiff requests a trial by jury and seeks liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by G. Scott Fiddler of Fiddler & Associates PC in Houston.
