GALVESTON – Galveston County property owners have filed a suit against their insurance agency alleging that it made false statements regarding the coverage of the insurance.
GYB Investors LLC, GYB Fuel Services LLC, GYB Management Services LLC and GYB Operator LLC filed a complaint on June 2 in Galveston County District Court against Victory Insurance Agency Inc. and Roger Montemayor alleging misrepresentation of insurance policy and other counts.
According to the complaint, the plaintiffs allege that they suffered damages to their property as a result of a windstorm in October 2015. They allege they submitted a claim for damages but were informed that it was not covered by their insurance policy, contrary to what they were informed before they bought the policy. The plaintiffs hold Victory Insurance Agency Inc. and Montemayor responsible because the defendants allegedly negligently misrepresented the policy when the plaintiffs purchased it.
The plaintiffs request a trial by jury and seek payment of an amount that would compensate plaintiff, all damages, interest, all legal fees and any other relief as the court deems just. They are represented by Mark C. Sparks and Michael A. Downey of Mostyn Law in Beaumont.
