Harris County lawyer accuses financial institution of negligence

HOUSTON — A Houston lawyer is suing a local financial institution, alleging breach of depository contract.

Robert Scott Williams filed a lawsuit Sept. 2 in Harris County District Court against Trustmark National Bank, alleging the bank negligently represented that funds were available for disbursement.

According to the complaint, Williams has suffered damages for being liable for the funds that Trustmark negligently wire transferred to his client in the amount of $177,300. The plaintiff alleges Trustmark's employees represented to him that cashier's check in the amount of $297,500 had cleared and that the funds were available in his account when, in fact, the cashier's check was counterfeit or fraudulent.

Williams seeks trial by jury, declaratory judgment that he has no liability to the defendant, plus attorney fees, court costs and all relief to which he is justly entitled. He is represented by attorney Gregg K. Saxe of The Law Office of Gregg Saxe PC in Houston.
