Family blames excavation contractor for man's death

HOUSTON — A widow, daughter and son are suing an excavation contractor, alleging its negligence caused the death of a family member. 

Maria Cruz, Cesilia Reyes and Arnold Reyes, individually and as heirs at law to the estate of Noe Reyes, deceased, filed a lawsuit Jan. 27 in Harris County District Court against Jaho Inc., alleging failure to provide a safe place to work.

According to the complaint, Noe Reyes was employed by Jaho when he died when a 15-foot trench around him collapsed on Aug. 8, 2016. As a result of his death, the plaintiffs suffered damages, the suit says. 

The plaintiffs allege Jaho proceeded with trenching and excavation operations with conscious indifference to the rights and safety of its employees and opted not to utilize a trench box even if it is available on location.

The plaintiffs seek trial by jury, damages in an amount to be determined by the jury, pre- and post-judgment interest, and all other just and proper relief. They are represented by attorneys Stuart R. White, Kevin W. Liles and Todd A. Hunter Jr. of Liles White PLLC in Corpus Christi.
