Former employee alleges company failed to pay overtime

HOUSTON — A Bexar County man is suing an oil field services business, alleging violation of workers compensation acts in failing to pay overtime.

Hernan Ferreyro filed a complaint Feb. 23 in the Houston Division of the Southern District of Texas against DXP Enterprises Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, between July 7, 2014, and April 9, 2015, Ferreyro was employed by the defendant as safety supervisor primarily testing for poison gas at and around oil field well sites. The suit says Ferreyro was paid a day rate and he routinely worked in excess of 40 hours per week but was not paid time and one-half his regular rate of pay for all hours worked more than 40 per week as required by FLSA. 

The plaintiff alleges DXP Enterprises failed to pay proper overtime and failed to maintain and preserve payroll records, which accurately show the total hours worked by the plaintiff on a daily and weekly basis.

Ferreyro seeks trial by jury, all damages allowed by the FLSA, legal fees, court costs, post-judgment interest and all other appropriate relief. He is represented by attorneys Allen R. Vaught and Melinda Arbuckle of Baron and Budd PC in Dallas.
