Vacation resort operator sued over cell phone calls

HOUSTON — A consumer is suing Silverleaf Resorts Inc., a vacation resort operator, alleging unlawful practices and invasion of privacy.

Steve Lynn Hughes of Porter filed a complaint on Sept. 29 in the Houston Division of the Southern District of Texas against Silverleaf Resorts Inc., alleging that the vacation resort operator violated the Telephone Consumer Protection Act and the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiff alleges that, in 2015, he began receiving calls on his cellular phone from the defendant, soliciting him to purchase a timeshare. As a result of these actions, he has suffered invasion of privacy, aggravation, emotional distress, increased risk of personal injury from distraction, increased usage of his telephone services and other pecuniary and non-pecuniary damages, the complaint says. The plaintiff holds Silverleaf Resorts Inc. responsible because the defendant allegedly continued to make calls multiple times during the same day, even after being informed that he was not interested in its services and to stop calling him.

The plaintiff requests a trial by jury and seeks damages of at least $500 per phone call and treble damages, costs, attorneys' fees and other appropriate relief. He is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group Ltd. in Lombard, Ill.
