Mother alleges dog obtained from Almost Home Pet Rescue, Petsmart injured child

HOUSTON – A Harris County mother alleges her minor child was injured by a dog that was advertised as an animal that would be safe around children.

Margaret Maag, individually and as next friend of her minor son R.M., filed a complaint on Nov. 21 in the Harris County District Court against Almost Home Pet Rescue Inc., Petsmart Inc. and Jennifer Lods alleging negligence.

According to the complaint, on Nov. 26, 2015, the minor child was watching television when he was viciously attacked by a rescue dog without provocation. The suit states that the dog was obtained from the defendants. 

The suit states the child sustained permanent, painful, impairing and disfiguring injuries to his body. 

The plaintiffs holds Almost Home Pet Rescue Inc., Petsmart Inc. and Lods responsible because the defendants allegedly failed to ensure that the subject dog was nonviolent.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million and all other appropriate relief. They are represented by John C. Clark of The John Clark Law Firm in Houston.
