Estate representative files suit seeking more than $10 million from PeroxyChem, others

HOUSTON – An estate representative residing in Harris County is seeking more than $10 million in damages after his decedent was injured in an explosion at a Pasadena plant.

James Giddens, individually and on behalf of the estate of Ricky Giddens, filed a complaint on Dec. 13, 2017, in the Harris County District Court against PeroxyChem LLC, Global Vacuum Solutions and Evergreen Industrial Services alleging negligence.

According to the complaint, Ricky Giddens was employed by Evergreen and was assigned to the PeroxyChem plant in Pasadena. The suit states on Jan. 16, 2016, Ricky Giddens was vacuuming oil from a tank into a vacuum truck when an explosion occurred and he was badly injured.

The plaintiff holds PeroxyChem LLC, Global Vacuum Solutions and Evergreen Industrial Services responsible because the defendants allegedly failed to recognize and remediate hazards, failed to provide warnings of the known dangers and failed to provide proper equipment and competent personnel.

The plaintiff requests a trial by jury and seeks damages of no less than $10 million, with interest and costs and other relief to which he may show himself justly entitled. He is represented by Anthony G. Buzbee and Christopher Leavitt of The Buzbee Law Firm in Houston.
