Former Hilmer Construction Services worker alleges he is owed unpaid overtime wages

HOUSTON – A construction worker has filed a class-action lawsuit against his former employers over allegations they failed to pay overtime premiums.

Jaime Mosqueda Sandoval, individually and on behalf of all others similarly situated, filed a complaint on Dec. 19, 2017, in the Houston Division of the Southern District of Texas against Hilmer Construction Services LLC, doing business as Ace Construction Services, and Hilmer James Morgan alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants from August to November 2016 as a construction worker. He alleges that he regularly worked 55 hours or more per week and was paid the same day rate regardless of the amount of hours he worked.

The plaintiff holds Hilmer Construction Services LLC and Morgan responsible because the defendants allegedly failed to pay the required overtime premiums for work performed in excess of 40 hours in most weeks.

The plaintiff requests a trial by jury and seeks unpaid overtime wages at the applicable rate, liquidated damages, prejudgment interest, costs and attorney’s fees and such further relief that is just and equitable. He is represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
