GALVESTON – A railroad worker alleges he is unable to work because of knee deterioration caused by an unsafe work environment.

Brian Brooks filed a complaint on Jan. 18 in the Galveston Division of the Southern District of Texas against Union Pacific Railroad Co. alleging that the interstate carrier violated the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that as a result of workforce reduction and increased workload while employed by the defendant, he was caused to suffer knee deterioration and pain that resulted in his inability to work after July 26, 2016.

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to provide a reasonably safe place to work.

The plaintiff seeks actual damages, post-judgment interest, costs and such other just and proper relief. He is represented by Marc A. Zito of Jones Granger Law Firm in Houston.
