HOUSTON – A man alleges he was injured while unloading equipment in Houston because a co-worker left to take a phone call.

Timmy Griffin filed a complaint on March 14 in the Harris County District Court against BPW Solutions LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 17, 2016, he was injured while working for defendant when a co-employee answered a phone call and left him alone to load heavy medical equipment. The suit states that he lost control of the equipment during loading and was thrown from the box truck and onto pavement.

The plaintiff holds BPW Solutions LLC responsible because the defendant allegedly failed to properly train its employees to follow the applicable guidelines when loading a truck.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but less than $200,000 and such other relief to which he is entitled. He is represented by Michael J. Lowenberg, Andrew D. Kumar and Kyle P. Knizner of Lowenberg & Kumar in Houston.
