Slip & fall against Beaumont McDonald’s settles before trial, plaintiffs sought $1M in damages

BEAUMONT – Before a jury could be selected, a slip and fall lawsuit brought by a Jefferson County woman and her child against a local McDonald’s restaurant settled.

Seeking up to $1 million in damages, Shannon McCain, individually and on behalf of her minor child, filed a lawsuit Feb. 19, 2016 in Jefferson County District Court against R.E.E. Inc. (doing business as McDonald’s).

Court records show the case was called up for trial on April 2. However, the case settled beforehand, according to a courthouse official.

According to the complaint, on March 15, 2014, the McClains were customers at a McDonald’s in the 1900 block of Frontage Road near College Station when N. McClain, slipped and fell due to water on the floor.

The suit alleged there were no “wet floor’’ signs to warn customers – even though employees were aware of the dangerous condition.

Court records show McDonald’s had answered the suit in April 2016, asserting the plaintiff had failed to exercise ordinary care.

The suit states the child suffered severe pain in her right knee, right arm and right elbow, with soreness to the body in general.

The suit was filed through attorneys Jonathan C. Juhan and J.J. Bragg of Beaumont.

McDonald’s is represented in part by James Isbell, attorney for the Houston law firm Thompson, Coe, Cousins & Irons.
