Worker alleges auger owned by Quanta Services fell, crushed foot

HOUSTON – A Harris County man alleges that he can no longer work in the construction industry after his foot was crushed by a piece of equipment.

Oscar Muniz filed a complaint on April 10 in the Harris County District Court against Quanta Services Management Partnership LP and Quanta Services Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on May 26, 2016, his fifth toe had to be amputated after a multi-ton auger fell on his foot while a co-worker was using it to drill a hole. The suit states the defendant bought the auger and created a base for it for transport and that the auger disconnected from the base while in use, falling on and crushing the plaintiff's foot.

The plaintiff holds Quanta Services Management Partnership LP and Quanta Services Inc. responsible because the defendants allegedly failed to provide safe equipment, failed to implement adequate policies and procedures to ensure worker's safety and failed to adequately supervise their workers.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 and such other lawful and equitable relief. He is represented by Jason A. Gibson and Casey L. Gibson of The Gibson Law Firm in Houston.
