Former The Examiner staff writer alleges she is owed unpaid overtime

BEAUMONT – A former staff writer for a Beaumont newspaper alleges she was not paid for overtime work and retaliated against for her complaints.

Eleanor Skelton filed a complaint on May 3 in the Beaumont Division of the Eastern District of Texas against The Examiner Corp., doing business as The Examiner, and Don J. Dodd alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a staff writer from September 2016 to February 2018. She alleges she routinely worked 50 or more hours per workweek and was told to take paid time off in lieu of receiving overtime pay. She alleges she was retaliated against by being denied raises and termination of her employment.

The plaintiff holds The Examiner Corp. and Dodd responsible because the defendants allegedly failed to pay overtime pay for all hours worked in excess of 40 hours per week and retaliated against her for her complaint regarding the unpaid overtime wages.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, attorney’s fees and costs, prejudgment and post-judgment interest and all other relief whether legal, equitable or injunctive. She is represented by Lionel Martin of Garcia-Martin & Martin PC in Sugar Land.
