TYLER – A Longview consumer alleges she has been harassed by a debt collector over a debt that has already been paid.
Jenita Williams filed a complaint on June 4 in the Tyler Division of the Eastern District of Texas against Edward Sloan and Associates Inc. alleging violation of the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff paid an alleged debt in May 2017 but the defendant continues to contact her in an attempt to collect it. She alleges in October and November 2017 she contacted the defendant to advise it that the debt had been paid, but the calls continued.
The plaintiff holds Edward Sloan and Associates Inc. responsible because the defendant allegedly continued to contact her after receiving written notification and harassed her with the calls.
The plaintiff requests a trial by jury and seeks actual and punitive damages, statutory damages of $1,000, litigation costs and attorney’s fees and all other relief to which she is entitled. She is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
