Consumer claims Perfection Collection reported debt that does not belong to him

HOUSTON – A consumer alleges that a debt collector is reporting an alleged debt on his credit report that belongs to a different individual with the same name.

Arturo Moreno filed a complaint on Aug. 9 in the Houston Division of the Southern District of Texas against Perfection Collection LLC alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 1, he first noticed that the defendant was reporting an alleged debt to Trans Union from Vivint. The plaintiff alleges that he has never obtained services or equipment from Vivint and has been unsuccessful in removing the debt from his credit reports. He alleges the debt belongs to a different individual with the same name.

The plaintiff holds Perfection Collection LLC responsible because the defendant allegedly used false, deceptive and misleading means to collect an alleged debt and failed to communicate that a debt was disputed.

The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages of $1,000, attorneys’ fees and costs and all other relief deemed appropriate by the court. He is represented by Leroy B. Scott of SmithMarco PC in Houston.
