HOUSTON – A state district lawsuit alleging that a waitress at a Louisiana casino restaurant spilled coffee on a visitor has been elevated to federal court.

Houston Division, Southern District of Texas records show that Golden Nugget Lake Charles, LLC and Fertitta Entertainment, Inc. submitted a notice of removal into Linda Harris’s personal injury case against them.

As previously reported in The Southeast Texas Record, Harris asserts a waitress at one of the defendants’ restaurants “negligently spilled scalding coffee” on her and caused her to suffer first degree burns to her back.

The respondents formally countered the allegations in an original answer filed on Oct. 5, exactly a month after the plaintiff initiated the litigation, according to recent Harris County District Court records.

Keith Christopher Bayko of The Bayko Law Firm in Bellaire is representing the defendants.
