HOUSTON – A Harris County consumer alleges a debt collector unlawfully contacted him at his workplace.
Gregorio Sosa filed a complaint on Oct. 10 in the Houston Division of the Southern District of Texas against Atlantic Credit & Finance Inc. alleging that the debt collector violated the Texas Debt Collection Act and the Texas Deceptive Trade Practices Act.
According to the complaint, a representative of the defendant contacted the plaintiff Aug. 15 at the plaintiff's place of employment. The plaintiff alleges he returned the call the next day and advised the representative that he could not receive personal calls at his place of employment. The plaintiff alleges he continued to receive calls at his workplace from the defendant.
The plaintiff holds Atlantic Credit & Finance Inc. responsible because the defendant allegedly communicated with him at his place of employment despite knowing he was not permitted to take personal calls at work.
The plaintiff requests a trial by jury and seeks actual and statutory damages, costs of court, attorney’s fees and such other and further relief deemed just and proper. He is represented by Daniel J. Ciment of Ciment Law Firm PLLC in Katy.
