PetSmart patron alleges store failed to warn of substance that caused fall

HOUSTON – A Harris County man alleges that he was damaged in the sum of more than $1 million after falling in a pet supplies store.

Joel Hyden filed a complaint on Nov. 5 in the Harris County District Court against PetSmart Inc. and PetSmart Inc. Store #201-Houston alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 21, 2016, he was injured when he slipped because of a substance on the floor on the way to the counter at defendants' store No. 201 in Houston. He alleges he sustained severe injuries resulting in disability, mental anguish, pain and suffering. He alleges he has been damaged in the sum of more than $1 million. 

The plaintiff holds PetSmart Inc. and PetSmart Inc. Store #201-Houston responsible because the defendants allegedly failed to inspect its premises to discover the dangerous condition, failed to make it safe and failed to provide adequate warning about it.

The plaintiff seeks judgment against the defendants in a fair and adequate amount to be determined by jury, with interest, costs and such other and further relief to which he may be entitled.
