2016 death of Dickinson first grader subject of Houston woman's lawsuit

GALVESTON – Timothy A. Beeton of the law firm Simpson & Beeton in Galveston has filed a lawsuit on behalf of a Houston woman whose minor son was allegedly hit to death two years ago, recent Galveston County District Court records show.

In the 9-page suit filed against David Jerome Brown, II and Tierra Phillips on Dec. 5 in the Galveston County 405th District Court, Mikisha Alcorn explains that 6-year-old Mar’Nijah Lamar Williams succumbed to injuries he sustained while at the defendants’ home on or around Dec. 5, 2016.

Alcorn had Mar’Nijah with Brown in February 2010, according to court filings.

The child, who was a first grade student at Lobit Elementary School in Dickinson Independent School District, reportedly went to the respondents’ residence after school.  The original petition says that “a witness reported hearing spanking and screaming coming from one of the bedrooms in the house that evening.”

“Mar’Nijah was later discovered unresponsive,” the suit says.

The boy was transported to the nearby Mainland Medical Center where he was declared dead.

Alcorn accuses the decedent’s father of “either negligently, intentionally, or knowingly” causing bodily injury to their son by striking him.

Authorities arrested and charged Brown with injury to a child with intent to cause bodily injury, a third-degree felony.

Consequently, the plaintiff unspecified monetary damages and a jury trial.
