Harris County couple alleges Phaze One Entertainment failed to refund $2,000 deposit

HOUSTON – A Harris County couple alleges their deposit was not refunded by an events center after damages caused by Hurricane Harvey prevented them from having their event there.

Clifton Turner and Margie Turner filed a complaint on Jan. 31 in the Harris County District Court against Phaze One Entertainment LLC, doing business as Eden Event Center, alleging breach of contract.

According to the complaint, the plaintiffs allege that on April 5, 2017, they contracted the defendant to lease the center to celebrate their 50th wedding anniversary in December 2017. The suit states they paid a $2,000 deposit to lease the space.

The suit states the event center was damaged by Hurricane Harvey in August 2017 and plaintiffs were notified that they would not able to use it for their occasion. 

The plaintiffs hold Phaze One Entertainment LLC responsible because despite written demand for the return of their $2,000 deposit, the defendant allegedly refused to return the same or any part thereof.

The plaintiffs request a trial by jury and seek judgment for $2,000 as the principal amount due, attorney fees of at least $7,500, interest, costs and such other relief to which they may be entitled. They are represented by Jimmy L.J. Brown Jr. in Houston.
