MARSHALL – A motorist is seeking damages from a trucking company and its driver over a collision in Tyler.

Tonya T. Etress filed a complaint on Feb. 12 in the Marshall Division of the Eastern District of Texas against US Nevada Truck LLC and Mario Yoandy Perez-Melian alleging negligence.

According to the complaint, the plaintiff alleges that on March 1, 2017, she was traveling north on Paluxy Drive in Tyler when defendants' tractor-trailer struck her vehicle. The suit states the tractor-trailer was operated by Perez-Melian.

The plaintiff alleges she suffered serious injuries that resulted severe physical pain and mental anguish and incurred medical expenses and lost wages of more than $100,000 as a result of the accident.

The plaintiff holds US Nevada Truck LLC and Perez-Melian responsible because defendant Perez-Melian allegedly failed to yield to the right of way, failed to make a proper left turn and failed to properly apply brakes.

The plaintiff seeks judgment against the defendants for her damages, interest, costs, and for such other and further relief to which she may be justly entitled. She is represented by G.R. (Randy) Akin of G.R. (Randy) Akin PC in Longview and Keith Miller in Tyler.
