Fatal Galveston crash that killed bicyclist, 23, produces lawsuit against bar

GALVESTON – A state district lawsuit has been filed in response to a single-vehicle accident last year that claimed the life of a bicyclist.

Recent Galveston County District Court records show that Sean O’Rourke of Simon & O’Rourke Law Firm, P.C. in Webster filed the suit on behalf of the parents of the late Marco Pena Beltran in the 405th District Court on Feb. 20.

The 5-page original petition accuses BOI Entertainment, LLC, doing business as Island Pier Club, of serving “a severely intoxicated” Gerilyn Weberlein alcohol prior to the June 4 collision in which she allegedly struck a group of bicyclists in the 3200 block of 69th Street in Galveston.

“When the defendant provided the alcoholic beverages to Gerilyn Weberlein, it was apparent to the defendant that Gerilyn Weberlein was obviously intoxicated and presented a clear danger to herself and others,” the complaint says. “Additionally, the defendant allowed Gerilyn Weberlein to leave the bar driving.”

Among the victims, the 23-year-old Beltran succumbed to his injuries. The other injured cyclist, Christian Tovar, is a co-plaintiff in the litigation.

Consequently, the complainants seek unspecified monetary damages and a jury trial.
