Restaurant sued for dropping intoxicated patron counters allegations

HOUSTON – A southeast Houston restaurant recently sued after one of its employees allegedly injured an intoxicated diner has responded to the litigation, according to Harris County District Court records.

Chilos Seafood Restaurant filed an original answer into Maleny Hernandez’s lawsuit on Feb. 20, generally denying her claims that a worker dropped her on the floor as she was being helped onto a counter at the eatery’s bar.

As previously reported in The Southeast Texas Record, the incident in question rendered the plaintiff unconsciousness with various head injuries.

In its 15-page response, Chilos asserts that Hernandez demonstrated “comparative negligence.”

Ashley Mannschreck of the Law Offices of David C. Klosterboer in Houston is representing the restaurant.
