HOUSTON – Miguel Bueno, of Harris County, is suing his apartment complex on allegations it sought to evict him when he expressed concerns about the property in the Energy Corridor section of Houston.

Bueno brought a lawsuit against Francis Property Management, which owns and operates the complex located at 770 N. Eldridge Pkwy., on Mar. 14 in the Harris County 127th District Court.

Court documents claim that a malfunctioning elevator prevented the plaintiff from evacuating shortly after Hurricane Harvey’s landfall on Aug. 25, 2017. Bueno was purportedly stuck in the elevator until his fellow neighbors helped him break free.

The 8-page original petition states that the plaintiff and several of the occupants subsequently “wrote a petition regarding the issues involved in repairing the damage to the apartments, chemicals being used, and reporting of losses.”

According to the suit, the respondent threatened to evict Bueno after receiving the petition while its legal counsel gave him a choice to move or stay.

He seeks unspecified monetary damages.

Colleen M. McClure of Houston is representing the complainant.
