METRO named in wrongful death suit claiming train fatally struck pedestrian

HOUSTON – Theresa Baranowski, of Harris County, has brought a wrongful death lawsuit against the Metropolitan Transit Authority of Harris County.

The suit, which was filed on Apr. 1 in the Harris County 190th District Court, lays responsibility for the Oct. 4, 2018 death of Kevin Jozwiak on the public transportation agency.

Court papers explain that Jozwiak was a pedestrian on East Crosstimbers Street attempting to cross Fulton Street on the date in question when a southbound MetroRail train “failed to yield the right of way” to the decedent and fatally struck him.

According to the original petition, the defendant’s rail safety officer ruled the subject event to be “preventable based on the failure of the METRO employee operating the light-rail train to react properly to the hazard ahead of the train.”

Baranowski seeks unspecified monetary damages and a jury trial.

She is represented by the law firm Armstrong Lee Savage LLP in Houston.
