HOUSTON — A Galveston man is suing a contractor and other defendants, alleging a security gate closed on the plaintiff, causing him to sustain physical injuries.
Michael Johnson filed a complaint April 5 in Harris County District Court against 2800 Gulf Freeway Ltd., McRee Family Trust, McRee Ford Inc., Comanche Contractors LP, New Comanche Contractors LLC., Structural Consultants Associates Inc., doing business as SCA Consulting Engineers Inc., Lentz Engineering LLC and Acosta Architecture LLC, alleging negligence and liability.
According to the complaint, Johnson was at McRee Ford, 2800 Gulf Freeway, Dickinson, on April 8, 2017 to discuss the purchase of a vehicle. The plaintiff says he was driving through a portion of the defendant's property that was open for public access when his car ran into the security gate that was halfway closed.
The suit alleges the door slammed Johnson into the steering wheel and caused him to jam his left wrist and sustain neck injuries. The plaintiff says he also sustained crushed nerves in his cervical spine and a sprain of his left wrist. His injuries required physical therapy and medical attention, the lawsuit states.
The suit says the defendants failed to protect the plaintiff from a known physical danger and failed to provide adequate warning.
Johnson seeks trial by jury, actual damages of more than $100,00, court costs and other just relief. He is represented by attorneys William K. Adams and Tomas A. Adams IV of The Adams Law Firm in Katy.
