MARSHALL — A Louisiana motorist is suing another driver, alleging he was injured when the defendant failed to maintain control of his vehicle.

Gregory C. Beard of Ouachita Parish, Louisiana, filed a complaint April 15 in the Marshall Division for the Eastern District of Texas against Tracy Osby and DCK Services LLC, alleging negligence.

According to the complaint, Bears was operating his vehicle April 3, 2018, on U.S. Highway 84 in Shelby County and Osby was driving a Volvo tractor, towing a trailer, owned by DCK Services. The suit says Osby failed to control the speed of his truck and trailer and struck Beard's vehicle, causing the plaintiff to be injured and resulting in physical pain and suffering and medical expenses.

The suit alleges Osby did not have a valid CDL license.

Beard seeks judgment of more than $75,000, trial by jury, costs of suit, compensatory damages and all just relief. He is represented by attorneys Josh B. Maness of Waskom and by Ryan H. Zehl and W. Lamar DeLong of Zehl & Associates PC. in Houston.
