HOUSTON — A Montgomery man is suing a debt collection agency, alleging the defendant misled him.
Michael B. Walker Jr. filed a complaint Aug. 28 in the Houston Division of the Southern District of Texas against Optio Solutions LLC, doing business as Qualia Collection Services, alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, Walker had a line of credit with Capital One with the balance of $1,331.44 when he defaulted on his credit. After this occurred, the plaintiff alleges he began to receive correspondence from Qualia, which was was trying to collect on the debt that the plaintiff had accumulated.
The defendant allegedly made representations to the plaintiff that it was collecting the debt on behalf of Capital One. In fact, the suit states, Qualia has no relationship to Capital One and therefore was misleading to Walker. The plaintiff says he has been caused to suffer due to the defendant's actions.
Walker seeks declaratory judgment against the defendant, punitive and actual damages, attorney fees, court costs and all just and appropriate relief. He is represented by attorneys Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group Ltd. in Lombard, Illinois.
