Employees allege Gulf Coast Pavers failed to pay for overtime hours

HOUSTON —Two employees are suing a Harris County business, alleging they were not paid for overtime hours worked.

Jose Marin Gutierrez and Jovani Lopez Lopez filed a complaint Aug. 30 in the Houston Division of the Southern District of Texas against Gulf Coast Pavers Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, Gutierrez cut and installed brick for Gulf Coast Pavers between 2017 and 2019, and Lopez Lopez was a supervisor from 2016-19 who mixed sand to lay the brick. The plaintiffs allege during the course of their employment they regularly worked in excess of 40 hours a week. Despite working overtime, however, the suit alleges, the defendant has failed to compensate the plaintiffs at an appropriate rate of 1 1/2 times per hour as required by FLSA.

Gutierrez and Lopez Lopez seek trial by jury, all unpaid overtime wages, attorney fees, liquidated damages, court costs and all just and proper relief. They are represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
