Daughter blames medical center for father's choking death

HOUSTON — A Montgomery County woman is suing a medical center, alleging her father choked on his food and died.

Michele M. Bolds, individually and as personal representative of the estate of Vernon Bolds, filed a complaint Sept. 6 in Harris County District Court against KPH— Consolidation Inc., doing business as North Cypress Medical Center, alleging negligence.

According to the complaint, Vernon Bolds was taken to North Cypress Medical Center on Sept. 10, 2017 for contracting pneumonia and not eating. The plaintiff said she requested that her father receive a purred and thickened food tray but a regular food tray was brought in. 

The lawsuit states Vernon Bolds ate the food and on Sept. 13, 2017, Michele Bolds was told her father was coding, which caused him to die of aspiration.

The plaintiff alleges her father sustained pain and suffering and mental anguish and she was required to pay funeral and burial expenses due to the defendant's negligence in not serving the correct food.

Michele Bolds seeks trial by jury, attorney fees, court costs, interest and all other just relief. She is represented by attorneys March A. Weycer and Che' D. Williams of The Weycer Law Firm PC in Bellaire
