Former Code 3 Emergency Physicians employee claims she was misclassified, denied overtime wages

SHERMAN — The previous owners of a Dallas-Fort Worth emergency and urgent care medical facility are facing a lawsuit by a former physician assistant who claims she was misclassified as an independent contractor and was not paid for overtime work. 

Susan Scott filed a complaint on Oct. 30 in the Sherman Division of the Eastern District of Texas against Code 3 Emergency Physicians, PA, alleging Fair Labor Standards Act (FLSA) violations. 

According to her complaint, Scott worked at the defendant's medical facility in Terminal D of the Dallas-Fort Worth Airport from June 2017 through October 2019 and was treated "the same as W-2 employees" at the facility, despite being categorized as an independent contractor. She alleges that she was paid straight time for her hours worked and that Code 3 failed to pay an "overtime premium for all hours worked over 40 in a work week."


Scott seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Philip Bohrer and Scott Brady of the Bohrer Brady Law Firm LLC in Baton Rouge, Louisiana.
