Spring school district employee alleges negligence for forklift injuries

HOUSTON — A Spring school district worker is suing the company that supplied a forklift to the district, alleging he was injured when the equipment malfunctioned.

Noel Baeza-Najera filed a complaint Nov. 27 in Harris County District Court against N.J. Malin R Associates LLC, alleging negligence.

According to the complaint, Baeza-Najera was operating a forklift provided by NJ Malin as part of his work for the Spring Independent School District on Feb. 7. The suit states the forklift malfunctioned and caused injury to the plaintiff's hips, back, stomach, cervical and shoulder, injuries that will lead to future physical impairment.

The plaintiff alleges NJ Malin failed to do adequate maintenance on the forklift and failed to provide a reasonably safe product.

The plaintiff seeks monetary relief, interest and all other just relief. He is represented by attorneys Fabiana Baum and Ronnie Turner Jr. of The Provost Umphrey Law Firm LLP in Beaumont.
