GALVESTON — Kia is facing a negligence suit filed by the wife of a man who died in a crash involving his Kia Sorento.
Carolyn Tidwell filed a complaint Jan. 7 in the U.S. District Court for the Southern District of Texas Galveston Division against Kia Motors America Inc., and Kia Motors Corporation alleging negligence.
Tidwell's husband Donny was killed on Oct. 31, 2019 when his 2016 Kia Sorento was struck by another vehicle on Interstate 10 in Chambers. Tidwell alleges her husband's fatal injuries were the result of his vehicle failing to protect him due to violations of "crashworthiness principles" including maintaining of survival space, proper restraint, prevention of ejection and post-crash fires.
Tidwell seeks monetary relief in excess of $75,000, trial by jury, interest and all other proper relief. She is represented by E. Todd Tracy, Andrew Counts and Wendell Martens of The Tracy Firm in Dallas.
