Union Pacific worker shot by paintball gun at rail yard, sues for more than $1 million

HOUSTON — A Union Pacific worker is claiming the railroad's negligence after he was chased, shot with a paintball gun and suffered injuries at a rail yard in Lousiana.

James Brousseau filed a complaint Jan. 20 in the Harris County District Court against Union Pacific Railroad Company alleging negligence. 

According to the complaint, Brousseau was working on a track switch for Union Pacific on a railroad yard in Shreveport, Louisiana where crews had previously heard gun fire with bullets hitting nearby rail cars. Brousseau alleges that on Feb. 4, 2017 while working at the rail yard at dusk, he was chased and had to dive down into an embankment and was hit more than 10 times in the back of his legs with a paintball gun. Brousseau suffered several injuries including aggravating his PTSD and a previous back injury he suffered in a helicopter crash while serving as a U.S. Marine.

Brousseau seeks monetary relief in excess of $1 million, interest and all other just relief. He is represented by Attorney Marc Zito in Houston.
