HOUSTON — A man who suffered a broken jaw and other injuries after being attacked by an alleged intoxicated patron at the House of Blues is claiming the establishment's negligence.
Terry Charlton filed a complaint Jan. 18 in the Harris County District Court against House of Blues Houston Restaurant Corporation, The House of Blues and Mitchell Whittington alleging premises liability, negligence, violation of the Dram Shop Act and assualt.
Charlton and his friend were at the House of Blues in Houston on Oct. 26, 2018. He alleges that while riding the elevator to the restaurant's second floor, an intoxicated man began to yell obscenities at them. Charlton claims the man then followed him into the second-floor bar where he punched him from the back causing his head to hit the bar, breaking his jaw and knocking out some of his teeth. He alleges the House of Blues' security guard failed to act despite the man being visibly intoxicated.
Charlton seeks monetary relief of more than $1 million, trial by jury, interest and all other just relief. He is represented by Kiernan McAlpine of The Daspit Law Firm in Houston.
