Woman claims two different contractors defrauded her over Hurricane Harvey damage repairs

HOUSTON — A Harris County woman is claiming two different contractors defrauded her out of more than $180,000 after failing to make the promised Hurricane Harvey damage repairs to her home and her daughter's home.

Nancy Smith filed a complaint Jan. 29 in the Harris County Circuit Court against Kenneth Hamilton, individually and doing business as Exterior Creations and Jose Gamez, individually and doing business as Quatro Home Improvement alleging breach of contract and unjust enrichment. 

Smith's home and her daughter's home were damaged in August of 2017 due to Hurricane Harvey. Smith hired Exterior Creations for repair and remodeling of the homes on Aug. 3, 2018. She alleges she paid Exterior Creations more than $115,000 who stopped working in May of 2019 without the work being completed. Smith then hired Quatro on June 3, 2019 and paid $34,000 and an additional $34,000 to expedite the work. Smith claims after the second payment, Gamez ceased work. 

Smith seeks monetary relief of more than $180,000, trial by jury, interest and all other just relief. She is represented by Byron Barclay of The Barclay Law Firm in Houston.
