Former Ennis Regional Medical Center Physician claims he is owed more than $150,000 in back pay

HOUSTON — A former Ennis Regional Medical Center doctor is suing its owners alleging he is owed more than $150,000 in unpaid wages. 

Herman Toliver, M.D., filed a complaint Jan. 29 in the Harris County District Court against Total Care 2 U LLC and Nhue Ho, M.D., alleging breach of contract and fraud. 

Toliver worked at the defendant's Ennis Regional Medical Center from December of 2018 until his resignation in August of 2019. He alleges that his former employer owes him $158,493 in unpaid wages since he was told not to cash his paychecks from March through April of 2019 due to alleged "poor cash flow." Toliver also claims he loaned the defendant $20,000 which has not be repaid.

Toliver seeks monetary relief between $200,000 and $1 million, trial by jury, interest and all other just relief. He is represented by Nicholas O'Kelly of Kilgore & Kilgore PLLC in Dallas.
